Report Waste, Fraud, and Abuse

Under CRS § 24-50.5-103 (3) to (10), the Office of Legislative Legal Services is a designated review agency for information/documentation that is believed to be confidential and that is evidence of waste, fraud, and abuse involving an officer or employee of the Department of Law. State employees may submit information about waste, fraud, and abuse involving an officer or employee of the Department of Law that includes information believed to be confidential or not subject to disclosure under the Colorado Open Records Act (“CORA”) to the Office of Legislative Legal Services for a determination of whether the information can be made public without violating the law. The Office of State Court Administrator is also a designated review agency for information/documentation that is believed to be confidential and that is evidence of waste, fraud, and abuse involving an officer or employee of the Department of Law.

If a state employee submits information believed to be confidential to the Office of Legislative Legal Services, the information should not be shared publicly, including with members of the Colorado General Assembly, until a determination regarding its confidentiality has been made. The Office of Legislative Legal Services is statutorily required to make this determination in writing within 30 days of receipt of the information.

NOTE: If the alleged waste, fraud, and abuse involves an employee of any agency of the executive branch of state government other than the Department of Law which includes the Attorney General’s Office, any officer or employee of the judicial branch, or any officer or employee of the legislative branch of state government, the information should not be submitted to the Office of Legislative Legal Services, but should instead be submitted to the Attorney General, which is a designated review agency.
