Representatives Kraft-Tharp and McKean,
co-prime sponsors, introduced House Bill 20-1133, concerning land use entitlements
affecting real property that has been disconnected from a municipality.
The bill prohibits a landowner from disconnecting their property
from a muncipality until property rights affecting the land have expired
or terminated. Any disconnected property will
be subject to the applicable county's zoning resolution map and land development
regulations within 90 days after the effective date of the disconnection.
The bill specifies that provisions in the county's zoning processes
applying to future disconnections are void. Once the land is disconnected
the county may start the process for land entitlement. The county
may decide not to issue a building or occupancy permit. In addition, subdivision
of the land may be pursued through county regulations. The bill requires
that statutory cities and towns completing disconnection through a court
decree are subject to the county's zoning resolution and other land development
regulations within 90 days after the effective date of the disconnection.
